The Office of the Public Conservator solicits volunteers to help with the many daily tasks and responsibilities that are assigned by the court. Medical consent laws allow a parent to authorize another adult to consent to medical, dental, and mental health care for their children and obtain access to health records. Consultation with doctors, attorneys and social workers may help in this decision. Educational consent laws, or open enrollment laws, allow grandparents or other adults who are raising a child without legal custody to enroll that child in public school. A court process is required to create a guardianship. It is recommended that all available alternatives be explored thoroughly before choosing this course of action. Guardianship is a legal relationship in which a person (s) or agency (the guardian) is appointed by the court to make decisions and act on behalf of a person who does not have adequate capacity to make such decisions involving the management of personal affairs, property, or both. After the court determines incapacitation, they become a protected person or ward. ![]() Until the court decides, the person is an alleged incapacitated person (AIP). First, the court must determine whether a person is incapacitated. Remember a conservatorship appointment involves taking away the right of self-determination. The Superior Court can assign a guardian to care for an adult who cannot care for themselves. This service is available in all 95 counties of the state through District Public Conservators located at all nine Tennessee Area Agencies on Aging and Disability. The forms are available from the Tennessee court system, county clerks offices, or online. The primary purpose of the program is to provide conservatorship services to persons 60 years of age and older, who are unable to manage their own affairs, and who have no family member, friend, bank or corporation willing and able to act on their behalf. Tennessee legal guardianship forms are documents that must be filled out and filed with the court in order to become a legal guardian of a minor child in the state of Tennessee. The Public Guardianship for the Elderly Program was established in 1986 by the Tennessee General Assembly for that purpose. ![]()
